Terms of service.

What you get, what you pay, what you may do with an analysis, and where liability sits.

The agreement

These terms govern your use of Beneath at usebeneath.com and of the API. By creating an account or running an analysis you accept them. If you are accepting on behalf of an organisation, you confirm you may bind it.

What the service does

You draw a boundary. We score the ground inside it, rank candidate drilling sites, and show the evidence behind each one. Depths, yields and costs are modelled ranges, not measurements or quotes.

Read the groundwater disclaimer before you act on an analysis. It is part of these terms, and it sets out the limits of the method in full.

Maps, plans and payment

Usage is metered in maps. The land you draw determines how many maps an analysis consumes, and the cost is shown before anything runs. Plan allowances reset each billing cycle and do not roll over.

Paddle acts as merchant of record. Subscriptions renew automatically until cancelled, and you may cancel at any time with effect from the end of the current cycle. Prices may change with at least thirty days notice before your next renewal.

Where an analysis returns insufficient evidence rather than a recommendation, the maps it reserved return to your balance. Beyond that, payments are non-refundable except where the law requires otherwise.

What you may do with an analysis

Results belong to you. You may use them inside your organisation, share them with your own advisers, contractors and clients in the course of the project they relate to, and include them in your own reports.

You may not resell, sublicense, white-label or redistribute analyses as a product or service of your own, whether through the interface or the API, without a written agreement with us. Nor may you use the service to build a competing product, or scrape, mirror or bulk-extract our outputs.

The API

API access is governed by the same terms plus any rate and volume limits stated in the developer documentation. Keep your keys secret; you are responsible for everything done with them. We may throttle or suspend a key that threatens the stability of the service, and we will tell you when we do.

Your account

Keep your credentials secure and tell us promptly if you think they have been compromised. Do not use the service unlawfully, do not attempt to breach its security, and do not submit boundaries you have no legitimate interest in.

Intellectual property

We own the service, the models and the software. You own your boundaries, your project names and your results. You grant us only the licence needed to run, store and deliver the service to you.

Third party data used in an analysis remains subject to its own licence. Where a source requires attribution or imposes share-alike conditions, those conditions travel with the output and are named in the analysis.

Warranties and liability

The service is provided as is. We do not warrant that an analysis will be accurate, that water will be found, or that the service will be uninterrupted or error free.

To the fullest extent permitted by law, we are not liable for drilling costs, dry holes, lost yield, lost profit, crop or business loss, or any indirect or consequential loss. Our total liability in any twelve month period is limited to the amount you paid us in that period. Nothing here excludes liability that cannot lawfully be excluded.

Suspension and termination

You may close your account at any time. We may suspend or close an account that breaches these terms, that puts the service or other customers at risk, or where payment has failed and remains unpaid after notice. On termination your data is handled as described in the privacy policy.

Changes and governing law

We may update these terms; material changes are notified by email or in the application at least thirty days before they take effect, and continued use after that constitutes acceptance.
